GOURMET GEAR ONLINE LTD. STANDARD TERMS & CONDITIONS OF SALE ('this agreement')
FOR THIS AGREEMENT:
"Customer" refers to any individual or entity placing an Order with Gourmet Gear Online LTD., whether as a private consumer or on behalf of a business.
"Goods" denotes any items sold or supplied by Gourmet Gear Online LTD. as specified in an Order.
"Gourmet Gear" indicates Gourmet Gear Limited, a company registered in England under company number 15586662, with a registered address 167-169, Great Portland Street, 05th Floor, London, England, W1W 5PF.
"Order" pertains to any request or order made (via phone, web order, or mail order) for the purchase of Goods.
"Parties" refers collectively to the Customer and Gourmet Gear.
VALIDITY

This Agreement constitutes the sole contract between the Parties, and any terms and conditions presented by the Customer shall not apply unless explicitly agreed upon in writing. By placing an Order, the Customer acknowledges the primacy of the terms and conditions outlined in this Agreement over any other agreements between the Parties, except for previously established Gourmet Gear Credit Account terms and conditions, which supersede this Agreement in case of conflict.
Gourmet Gear retains the discretion to accept or reject any Order. Acceptance of payment for Goods does not automatically imply acceptance of the Order by Gourmet Gear.
Gourmet Gear reserves the right to amend the terms and conditions of this Agreement periodically by publishing updated terms and conditions on the Gourmet Gear website or catalog.
GOODS BEING SOLD

Descriptions and specifications of the Goods are available on the Gourmet Gear website or catalog at the time of placing the Order, provided that the catalog is current at the time of the Order.
Orders for Goods in specific colors, patterns, or designs are subject to stock availability. Gourmet Gear may substitute such Goods with newer or comparable items, with the approval of the Customer.
In case of unavailability or stock shortage of any Goods, Gourmet Gear reserves the right to cancel the Order either wholly or partly, refunding any payments made or issuing a credit note. Alternatively, Gourmet Gear may seek approval from the Customer to modify the Order.
Customers ordering age-restricted items such as solvents and knives affirm that they are at least 18 years old and agree that delivery will be accepted by an individual aged 18 or older.
TERMS OF PAYMENT AND PAYMENT METHODS

Prices for the Goods are as listed on the Gourmet Gear website at the time of placing the Order. Prices in the Gourmet Gear catalog are indicative only. Gourmet Gear may adjust prices at its discretion, and in case of conflict between prices listed on the Gourmet Gear website and catalog, the former shall prevail. Additional charges, including delivery and/or insurance fees, may apply.
Unless stated otherwise, all quoted prices exclude Value Added Tax (VAT), which will be charged according to prevailing regulations at the time of the Order.
Gourmet Gear reserves the right to decline to honor an incorrect price or description caused by errors.
Payment for Goods and Delivery can be made through various options listed on the Gourmet Gear website or catalog. Cheques and cash require a minimum of six working days to clear. Payments must reference the Customer account, order, or quote number. Gourmet Gear may withhold or decline further shipments until all overdue accounts are settled. A £25.00 administration fee applies to any payments returned unpaid by a bank.
Late or overdue payments may incur an interest charge of 8% above the base lending rate of the Bank of England, calculated monthly, at Gourmet Gear's discretion.
All Orders are subject to additional credit or security checks.
Gourmet Gear's Price Promise ensures matching any lower published price for a like-for-like product offered under the same terms in the UK, with certain conditions outlined. Comparisons exclude products from companies within the Gourmet Gear group.
DELIVERY

Comprehensive delivery options and prices are detailed on the Gourmet Gear website or catalog, subject to occasional changes.
Standard and Premium Delivery Orders within the UK mainland are scheduled for 'next day delivery' if the Order, along with the relevant delivery charge, is accepted by Gourmet Gear before 4.00 pm on a working day, provided no additional security checks are necessary and the Goods are available. Delivery within five days is expected for Orders unable to be delivered 'next day'.
Delivery times for Offshore/Remote locations may vary and cannot be guaranteed.
While Gourmet Gear endeavors to meet delivery estimates, it disclaims liability for any loss or damage arising from delivery delays.
Risk in the Goods transfers to the Customer upon delivery, but title does not pass until full payment is received.
Customers assume responsibility for the safe usage, storage, and installation of delivered Goods. Gourmet Gear disclaims liability for any resulting damage, loss, or disruption. Additional charges and conditions may apply for installation/disconnection services.
Large machinery, refrigeration, and flat-packed Goods are delivered to ground-floor locations only. Delivery personnel may, at their discretion, assist in delivering Goods within the Customer's premises, at the Customer's risk.
WARRANTIES AND RETURNS

Subject to specified conditions, Goods sold within the UK mainland may be returned for a refund, exchange, or replacement within 30 days. Returns must meet the criteria for unused, saleable condition, and original packaging. Partial refunds may apply to opened, marked, or used Goods. Certain items may be non-returnable due to hygiene reasons or special order status.
Goods are guaranteed against defects as per the manufacturer's warranty or for one year from delivery unless otherwise stated. Faulty Goods within the warranty period may be repaired, replaced, or exchanged at Gourmet Gear's discretion.
Reports of missing or damaged Goods must be made to Gourmet Gear within 24 hours or upon delivery, as applicable.
Warranty exclusions apply to defects caused by Customer negligence, misuse, or failure to adhere to manufacturer instructions. Certain items have limited warranty coverage or may require specific handling procedures.
Disposal of old electrical and electronic equipment may be arranged in compliance with WEEE regulations, with details available on the Gourmet Gear website.
Statutory rights for private consumer Orders remain unaffected.
TERMINATION

Gourmet Gear reserves the right to cancel or suspend Orders in case of non-receipt of payment as per Clause 3.
Orders may be canceled, and this Agreement terminated if the Customer faces insolvency, bankruptcy, or similar circumstances affecting its ability to pay debts.
Performance under this Agreement may be suspended or terminated due to reasons beyond Gourmet Gear's reasonable control, including force majeure events.
LIMITATION AND LIABILITY​

The Customer acknowledges that Gourmet Gear shall not be liable for losses or damages, including consequential loss or business interruption, arising from the use or purchase of Goods. Gourmet Gear's liability for injury or death remains unaffected.
Goods are uninsured during delivery unless otherwise confirmed by Gourmet Gear
